Right to Build on Top or below a Building - Derecho de Vuelo

416. When you are looking to purchase a house, in this case in Spain, one has to see the future potential of that property. One way of adding value to it is by building on top. There are however limitations to this. in Spain is known as the "Derecho de Vuelo" and the City Hall will confirm if this is possible. it is only possible to have this in building which already exisit or that have a project. This right to build  must be for a short period of time , in Cataluña this right must not exceed the term of 30 years.

The right to build, once confiremd and obtained, it perpetuates in time . There are two typed of right to build: 
1) right to overvalue 
2) right to subconstruct 
depending it is building on top f the last floor or below of the very first floor of the building. 
It is very imporant to keep in mind that shoudl this right be exercied, one will have to make sure it is in teh new community statutes as well as getting   unanimously approved by the whole building.
